Fixed-term employment contract to replace an employee during their justified absence from work

A replacement contract may be concluded in connection with vacation leave, illness or other justified absence of an employee. This solution is beneficial for the employer, because it allows to hire a replacement employee, so that continuity of work will be maintained. In February 2016, the regulations came into force, according to which the replacement contract will be considered a sub-type of a fixed-term employment contract and will not be distinguished by separate provisions.

A replacement contract is a specific type of employment contract, which from February 22, 2016, is indirectly regulated in Art. 251 § 4 of the Labor Code (Journal of Laws of 2016, item 1666, as amended). It provides that an employment contract concluded to replace an absent employee is not subject to fixed-term employment limits.
