Description
Overtime may be ordered by the employer, regardless of the type of position and the nature of the work performed. This obligation comes from Art. 100 § 1 of the Labor Code
An order to work overtime is a legally permissible professional order, given by an employer to an employee. It can be used regardless of the type of position or nature of work performed. Working overtime should take place at the employer’s request. The order may be given in any way, by any behavior of the superior which sufficiently discloses his/her will. An order to perform overtime work is also binding for an employee when he/she was entrusted with work of a different type than the agreed one (judgment of the Supreme Court of July 1, 1990, I PRN 7/90, PS 1992, No. 2).
